We inform you that ESCALA may carry out national or international transfers, by any means, of your personal data to: (i) Related parties (understood as all those affiliated, subsidiary, or affiliated companies), and (ii) Customers or business partners with whom ESCALA has, is about to have, or has had a legal relationship in the interest of the data subject, solely for the purpose of fulfilling the purposes established in this privacy notice.

In addition to the above, if it is necessary to process your personal data for a purpose not related to the aforementioned legal relationship, you will be informed of such purpose through the modification of this privacy notice, which will be made available to you again in a timely manner. The data subject may revoke the consent granted to ESCALA, in writing to the email address sistemas@escala.com.mx, the data subject must attach the documentation that proves their identity, any other element or document that facilitates the location of personal data, and state the legitimate cause and specific situation for which the request to revoke consent arises. Additionally, the data subject has the option to limit the use of their personal data for marketing, promotion, advertising, and/or commercial prospecting purposes, by registering (with a validity of 2 years) in the Registry of Users (REUS) managed by The National Commission for the Protection and Defense of the Users of Financial Services, at the phone number: 800 999 8080 or through the website https://www.condusef.gob.mx.

ESCALA designates the Systems Department (the “Data Protection Officer“) to handle and process requests from data subjects for the exercise of their ARCO rights as referred to in the Applicable Regulation (Access, Rectification, Cancellation, and Objection). Data subjects have the right to request access, rectification, cancellation, or objection to their data, by submitting a written request to ESCALA at the following address: Blvd Antonio L Rodriguez 1884 L6 PH3, Colonia Santa María Monterrey, Nuevo Leon C.P. 64650, from 9:00 a.m. to 6:00 p.m. on business days, or by sending a written request to the email address sistemas@escala.com.mx. ESCALA will respond to data subject’s requests, provided that none of the exceptions contained in the Federal Law for the Protection of Personal Data in the Possession by Individuals (Law) apply, and the requester meets the requirements set forth in Article 29 of the Law, described as follows: Indicate the name of the data subject and address or other means to communicate the response to the request; Provide documents that prove the identity or, if applicable, legal representation of the data subject; Present a clear and precise description of the personal data for which any of the aforementioned rights are to be exercised; and Include any other element or document that facilitates the localization of the personal data, such as the company to which the data was provided, the person to whom the data was provided, or the department of the company to which the person to whom the data was provided belongs. The response to the request for the aforementioned rights will be notified to the data subject by the Data Protection Officer via email, within a maximum period of 20 (twenty) business days, counting from the day of receipt of the request. In case additional information is requested, the period will be counted from the date of receipt of the complementary information. The exercise of any ARCO right is not a prerequisite nor does it prevent the exercise of another. Finally, in the event that you have provided personal, sensitive, patrimonial, or financial data of other data subjects, you also accept and acknowledge (i) the obligation to inform those data subjects of this privacy notice, (ii) to inform them that you have provided such data to ESCALA, and (iii) to assume all responsibility arising from the obligation to obtain authorization or consent from those data subjects to transfer their data to ESCALA. Likewise, you accept and acknowledge that you will be required to provide your own privacy notice and adjust it so that the purposes of processing are consistent with this privacy notice.

This privacy notice, as well as its modifications, will be made available to you on the website www.escala.com.mx or through notices posted in our offices or informed by any means of communication we have with you.

We reserve the right to make modifications to this privacy notice at any time and adapt it to the any new legislation, legal precedents, and market practices.

It is the user’s responsibility to read the privacy notice periodically to be aware of possible modifications. Once introduced on the website, the modification will automatically take effect.

With this privacy notice, data subjects are properly informed about the data collected from them and for what purposes, accepting the terms contained herein, which were prepared in compliance with the Federal Law for the Protection of Personal Data in the Possession by Individuals. This privacy notice, as well as ESCALA’s overall handling of the Law, is governed by the current and applicable legislation in the United Mexican States. Any dispute arising from its application shall be settled before the competent Jurisdictional in the City of Monterrey, N.L.
